Terms of use.

This is a translation for convenience. The German version is the legally binding one.

1. Scope and operator

These terms apply to the use of "Wir kaufen deine PokeCards" ("the website"). It is operated by Georg Dehling, reachable via the details in the legal notice. How we handle personal data is described in the privacy policy.

2. Test phase

The website is currently being tested. In particular, trading, buying, selling and the marketplace are in development; there is no working service for them yet. During the test phase:

• Prices, estimates and offers on the website are test data and not binding, even where they are called "binding".
• Sell requests, accepted offers, marketplace requests and trade proposals do not create contracts – neither with us nor between users.
• We make no payments and neither accept nor ship cards. Do not send us cards; we take no responsibility for cards sent unsolicited.
• Features may change or disappear at any time and test data may be reset. Use the export to keep a copy of your collection.

Before these features launch for real, we will update these terms and ask you to accept the new version.

3. User account

You can use the collection without an account. Selling, the marketplace and trading need a free account. You must be of age or have your guardians' consent. Keep your login details secret; you are responsible for actions taken through your account unless you are not at fault for its misuse. One account per person.

4. Collection and your content

Photos, notes and details you upload remain yours. You only grant us the rights we need to store them for you and – where you offer cards – to show them to other users or our team. Only upload content you hold the rights to and that is lawful.

5. What you state about cards

When you offer cards to us, list them in the marketplace or propose them in a trade, you warrant – and confirm this explicitly with every offer – that

• the cards are exactly as stated in language, edition and condition,
• they are original cards (no counterfeits, reprints or proxies),
• they belong to you and you may dispose of them, and
• all other details (photos, quantity, notes) are true.

False statements can lead to exclusion from selling and the marketplace or to the account being blocked. Knowingly offering counterfeits may have legal consequences.

6. Selling to us

You put cards from your album on the sell stack and send us a request. We review it and may make you an offer, which you can accept or decline. There is no right to receive an offer. While the test phase lasts (section 2), requests and offers are not binding.

7. Marketplace and trading between collectors

In the marketplace, members can show cards from their album for trade or sale and send requests. We only provide the platform; we do not become a party to any contract, do not check the cards and do not guarantee any deal. Contact details only become visible once a request is accepted. During the test phase (section 2) no contracts arise from this.

8. Prohibited use

In particular, the following is not allowed: automated reading of the website (scraping, bots) or of the price list, attacks on the technology or circumventing protective measures, spam and harassing other users, offering counterfeits and any unlawful use. In case of violations we may remove content and block accounts.

9. Availability and liability

The website is provided free of charge and – especially during the test phase – without any guarantee of constant availability or freedom from errors. We are liable without limitation for intent and gross negligence and for injury to life, body or health. For slight negligence we are only liable for breaches of essential obligations, limited to the foreseeable damage. We are not liable for deals between users.

10. Trademarks

This is an independent fan project. Pokémon and the related names and images are trademarks of their owners (The Pokémon Company, Nintendo, Creatures, GAME FREAK); we are not affiliated with them. See the legal notice.

11. Termination and deletion

You can have your account deleted at any time; write to us using the contact details in the legal notice. We may block accounts for breaches of these terms or end them with reasonable notice, for example if we discontinue the service.

12. Changes to these terms

We may change these terms, for example when buying and the marketplace launch for real. We announce material changes; the new version only applies to you once you agree to it. Without agreeing you can keep using the account for your collection or have it deleted.

13. Applicable law

German law applies. If you are a consumer, the mandatory protective provisions of the country where you habitually reside remain unaffected.
